This Terms of Service ("Agreement") governs your use of Chalzy, a platform that allows customers to create challenges to engage and attract customers. By accessing or using our service, you agree to be bound by this Agreement and our Privacy Policy. If you do not agree to these terms, do not use our services.

2. Account Registration

To access our service, users must register an account by providing their email, name, and phone number. Users are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account. You agree to immediately notify us of any unauthorized use of your account or any other security breach.

By signing up with our service, you will automatically be subscribed to the our email list. You may unsubscribe from this list at any time if you desire. We will not share your contact information with third-parties.

3. Prohibited Uses

The use of our service for illegal or pornographic purposes is strictly prohibited. Additionally, users must not manipulate or encourage illegal or unethical activities through the use of our platform. We reserve the right to terminate your use of the service for violating any prohibited uses.

4. Intellectual Property Rights

All content and data uploaded to our platform are owned by Bubblehead Technology, Inc. This includes, but is not limited to, text, graphics, images, and software. User-generated content is stored and may be used at the company's discretion. Users grant us a non-exclusive, royalty-free license to use, reproduce, modify, and display the content provided.

5. Termination of Service

We reserve the right to terminate or suspend your account and access to the service for violations of this Agreement or for abuse of the platform's limits. Upon termination, your right to use the service will cease immediately.

6. Disclaimer of Warranties

Our service is provided on an "as is" and "as available" basis. We do not warrant that the service will meet your requirements or that it will be uninterrupted or error-free. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that our service will gain customers for our users or engage them. We cannot guarantee it will provide them any return on their investment of time or money on our platform. We do not guarantee any uptime unless specifically explained in a custom agreement.

7. Dispute Resolution

For any disputes, contact help@chalzy.com. We will attempt to rectify the situation, relying on the state legal service if necessary. Any disputes arising out of or related to these terms shall be resolved in accordance with the laws of the State of Georgia, USA, and shall be subject to the exclusive jurisdiction of the courts of that state.

8. Amendments to Terms of Service

We may update these terms at any time. We will notify users of any changes via email or upon signing into our service. Your continued use of the service after such changes constitutes your acceptance of the new terms.

9. Governing Law

This Agreement and your use of the service shall be governed by the laws of the State of Georgia, USA, without regard to its conflict of laws principles. Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights.
